Terms of Use for Image Bank Sweden 

1. Area of use 

The images may be used in editorial material but not for commercial use, with the exception of specific images that may be used by the travel industry (travel trade). These images are clearly marked. A byline must always be given. In those cases where the Terms of Use are not followed, the user may be charged afterwards.

The images in the image bank may only be made available for the purpose of promoting Sweden in foreign media (and in Swedish media with an exclusively foreign audience). The images may also be used in the information work of the organizations which are part of the Council for Promotion of Sweden Abroad (NSU). These conditions apply provided that nothing else is specified under Limitations.

In this context, media should be understood in a broad sense as including publications, exhibitions, CD-ROMs, broadcasting media and the Internet.

Editorial material, for instance annual reports of individual companies or other specific company information, is not considered general promotion of Sweden.

2. The user 
These contractual terms are binding on the user. A person who uses Image Bank Sweden has accepted the Terms of Use by filling out the registration form and registering as a user. 

To use Image Bank Sweden, the user is assigned a user name and a password. This user information is strictly personal and the user is responsible for ensuring that they are not revealed to any third party. The personal information thereby provided in order to open an account must be truthful. 

The user is responsible for ensuring that the username and password are not misused. The user will be liable for damages if the user name and password assigned are used by someone who is not authorized to do so.


3. Copyright 
Image Bank Sweden’s images are protected by copyright. The copyright to the images is not transferred to the user.


4. Report on usage of images 
The user undertakes to provide a complete and correct report on how the images will be used. Before an image is downloaded and used, the type of usage and other information (name, type, print run, period, date) must be reported on the form found in the Image Bank.


5. Rights and restrictions 
The user receives a personal, non-transferable and non-exclusive right of usage for a single occasion. Images may not be transferred, rented out, distributed or otherwise duplicated. This right must be utilized within six months from downloading.

The user must always observe any restrictions concerning images that may be stated in the texts accompanying the caption of each respective image and the conditions stated in these contractual Terms of Use.

Images may not be used in advertisements or to market any specific company, product or service. However, this does not apply to images labeled "OK for Travel trade". If commercial use is in conjunction with the overall aim of promoting Sweden and the user belongs to the category "Travel trade" (Travel industry), then the images in question may also be used in advertisements and in conjunction with other marketing activities.

Advertisements for products, that is, goods and/or services that are shown in direct connection with an image, are not considered to promote Sweden.

The user is otherwise liable to Image Bank Sweden and the responsible NSU organization for the publication and usage of the images. The organizations behind Image Bank Sweden reserve the right to deny the user continued access to the Image Bank and usage of its images. In case of such denial, all digital and downloaded copies of images in the possession of the user must be erased and images from Image Bank Sweden published by the user must be removed.



6. Byline 
Both the name of the photographer, the copyright owner and the name Image Bank Sweden must always be stated when an image is published.

The byline must always be given as follows: "Photo: www.imagebank.sweden.se © Name of photographer / Copyright owner". In cases where this is not followed, the user may be charged afterwards.


7. Protection of persons and trademarks
According to the Swedish Act on Names and Pictures in Advertising (1978:800), a business person may not, in the marketing of any goods, service or commodity, make any representation in which another person’s picture is used, without that person’s consent. Responsibility for ensuring that such consent is obtained rests entirely on the user. This does not apply, however, to images labeled as approved for "travel trade".

If the work, trademark or other intellectual property of another copyright holder appears in an image, the user is responsible for obtaining the required consent and is solely liable for any claims of damages. If an image of a person is presented in a way or in a context that may be perceived as offensive, disparaging or otherwise sensitive, or in a publication that the person does not wish to be part of, the user is liable for any claims of damages. The same applies if the usage of the image violates the intellectual property rights of the copyright holder.


8. Editing of images 
No image may be subjected to distortion or modification beyond the bounds of normal editing, whether by electronic means or otherwise, without the express permission of the photographer. 

Such permission is also required if an image or part of an image is to be used in conjunction with another image (montage) in such a way that it appears to the observer as a new image. 

Liability for and any claims of damages as a consequence of such unauthorized usage of images rests entirely with the user.


9. Storage 
Images downloaded from Image Bank Sweden may be stored digitally but for no other purpose than that agreed on or for no longer a period than is needed for the agreed usage. After this one-time usage, or once an image is not utilized within six months of downloading, all digital and other copies of the images must be erased. 

When an image is to be republished, it must be downloaded once again with a correct and complete report on usage using the form found on the Image Bank website.


10. Limitation of liability 
The organizations behind Image Bank Sweden are not liable for damages or other consequences if the completion of their commitments is made difficult due to circumstances that Image Bank Sweden could not reasonably control, such as public regulation, public action, act of war, strike, blockade, boycott, lockout, computer malfunction, server malfunction, telecommunications malfunction or other similar circumstance, or an equivalent circumstance affecting a supplier. 

The organizations behind Image Bank Sweden are not liable for damages due to delay, malfunction or omission related to an image or transmission of an image or malfunction or interruption in the digital service. Nor are the organizations behind Image Bank Sweden liable for any incorrect or faulty information. They are in no case liable for indirect damage or consequential damage.


11. Offensive use 
An image may not be used for a purpose that may be perceived as offensive. 


12. Choice of law and court
Swedish law applies to this contract. Disputes must, in the first instance, be submitted to a Swedish court of law.
